What is a Mediator invoice?

A mediator invoice is issued by a civil, commercial, or family mediator to the parties in a dispute for facilitation of the mediation process. Mediators are neutral third parties who help disputing parties reach settlement without litigation, and their fees are typically shared equally between the parties unless otherwise agreed. In commercial and civil mediation, fees are commonly charged on a half-day or full-day basis for the mediation itself, with separate charges for pre-mediation preparation, reading bundles, drafting settlement agreements, and any follow-up communications. Rates vary significantly by the mediator's experience, accreditation body, and the complexity of the dispute. Family mediators operating under Legal Aid arrangements invoice differently, claiming from the Legal Aid Agency rather than the parties directly. Privately funded family mediation and all commercial mediation involves direct invoicing to the parties. Mediators accredited by the Civil Mediation Council (CMC), CEDR, ADR Group, or RICS (for construction and property disputes) will often reference their accreditation on invoices as it reinforces credibility and justifies premium rates.

How to invoice as a mediator

Commercial mediators typically invoice each party for their share of the fee, which is usually 50/50 unless the parties have agreed otherwise. Issue separate invoices to each party rather than a joint invoice to avoid complications with payment and confidentiality. Request a booking deposit (commonly one half-day fee) at the time of appointment to secure the date. Issue a final invoice after the mediation, crediting the deposit and adding any overrun time, preparation charges, and expenses. Clearly set out your cancellation policy on your invoice and engagement letter. Mediators commonly charge 100% of fees for cancellations within 7 days of the mediation and 50% for cancellations between 7 and 28 days. Slot loss is a real cost given that dispute resolution dates are often booked months in advance. For Legal Aid family mediation, invoicing goes directly to the Legal Aid Agency using their prescribed forms and rates. Private family mediation invoices parties directly using the same commercial approach described above.

Frequently asked questions

What is the typical day rate for a commercial mediator in the UK?
Experienced commercial mediators accredited by CMC or CEDR typically charge £1,500 to £3,500 per full day in 2026. Less experienced or newly accredited mediators may charge £600 to £1,200. RICS-accredited property mediators often sit in the £1,000 to £2,000 range.
Who pays the mediator's fee?
In commercial disputes, parties usually split the fee equally. This is agreed in the mediation agreement. Occasionally one party pays the whole fee as part of a settlement or tactical decision. Always confirm the payment split before the mediation.
Should mediators charge VAT?
Yes, if your annual taxable turnover exceeds the £90,000 VAT registration threshold. Mediation services are standard-rated at 20%. Legal Aid family mediation involves specific Legal Aid Agency payment arrangements.
Can I invoice for a cancelled mediation?
Yes. Your cancellation charges must be clearly set out in your engagement terms. Courts have upheld mediator cancellation fees where the mediator had turned away other work. Document your loss of opportunity if a case proceeds to litigation after your fee is disputed.
How do I handle confidentiality on invoices?
Use matter reference numbers rather than party names and dispute details on invoices, particularly if sending by email. Your invoice can reference the mediation date and fee without disclosing the nature of the dispute.
Can I use this template for free?
Yes. Tidybill's free plan lets you create up to 5 invoices per month at no cost, with no credit card required. You can use the Mediator invoice template straight away after signing up.
